Dopo il primo video su Cryptodata Misterhelmet ha ricevuto da Youtube, su richiesta della stessa azienda rumena, una sanzione per violazione di Copyright con relativa rimozione del video. Misterhelmet ha fatto ricorso e ha dimostrato la legittimità del lavoro giornalistico svolto. Sanzione ritirata e video ripristinato.

Torniamo dopo alcune settimane sul tema Cryptodata e sulla  la storia del copyright violato.
Come sapete sono impegnato in una battaglia contro i fake,  contro le truffe, e segnalo regolarmente sponsor anomali e situazioni poco chiare.
Misterhelmet da tanti anni effettua analisi, fa investigazioni, investigazioni e  fino adesso è sempre riuscito,  anche con l’aiuto di tanti lettori, a tirare fuori un sacco di cose strane.

Una di questi scenari che non mi tornavano o che comunque avevano delle situazioni poco chiare era la situazione di Cryptodata, uno sponsor che ha acquisito parte del team RNF.

Misterhelmet è uscito con un titolo chiamato “Rivelazioni sconvolgenti”,  in cui è stata esposta tutta la documentazione  relativa alle strane vicende di Cryptodata, del passato di Ovidiu Toma, il suo amministratore delegato, e tutta una serie di contenuti.

APRILIA RNF E CRYPTODATA: RIVELAZIONI SCONVOLGENTI!

Questa storia non è piaciuta a Cryptodata che però si è guardata bene dal rispondere alle argomentazioni Diciamo che Cryptodata per tre volte non ha avuto il coraggio di rispondere.
Inizialmente non lo ha fatto in merito ai miei video e ai miei articoli perché forse alcune situazioni  erano veramente poco chiare,
Quello che però ha fatto è stata una segnalazione per violazione di Copyright nonostante il materiale da me utilizzato fosse tutto di pubblico dominio.

E’ un atteggiamento intimidatorio perché chi riceve una violazione di copyright se ne guarda bene dal protestare dato che solitamente ci sono poi implicazioni legali e c’è sempre paura di dover finire in tribunale.
Nel mio casco non è stato così, ho inviato la mia contro notifica e nel frattempo ho postato un altro video in cui ho fatto, a Ovidiu Toma, alle persone di Cryptodata e ad altri esponenti, circa 40 domande a cui nessuno ha avuto il coraggio di rispondere.

 

CRYPTODATA ha PAURA di MISTERHELMET? Domande a Ovidiu Toma, Dorna e Aprilia!

Contestualmente la mia contro notifica è stata inoltrata all’autore che ha avuto 10 giorni lavorativi per dimostrare di aver intentato un’azione legale nei miei confronti e per dimostrare che sussiste una violazione reale del copyright.
Ho fornito i miei argomenti ma la prima contro notifica, per sicurezza è stata respinta in quanto Cryptodata ha chiesto tempo a Youtube e Youtube ha chiesto ulteriori spiegazioni a me.

Dopo 3 settimane Youtube non avendo ricevuto spiegazioni da Cryptodata e avendo ritenuto soddisfacenti le spiegazioni di Misterhelmet, ha deciso di respingere le contestazioni di Cryptodata e ripristinare il video nel rispetto del Digital Millennium Copyright Act. Misterhelmet 2 Criptodata 0.

E’ tipico dei tempi più recenti quello di intimidire tramite azioni legali e diffide, come già accaduto per altre situazioni. Misterhelmet, ha già affrontato questo tipo di situazioni diverse volte ma, forte delle sue argomentazioni, non si è mai fermato.
E’ la differenza fra un’informazione pavida e al servizio dei potenti e un’informazione indipendente.

We return after a few weeks to the CryptoDATA topic and the story of copyright infringement.
As you know, I am engaged in a battle against fakes, against scams, and I regularly report anomalous sponsors and unclear situations.
For many years, Misterhelmet has been carrying out analyses, lots of investigations and so far has always managed, thanks to the help of many readers, to come up with a lot of strange things.
One of these scenarios that did not sit well with me, or at least had an unclear situation, was the one of CryptoDATA, a sponsor that acquired a part of the RNF team.
Misterhelmet came out with a video with the title ‘Shocking Revelations’, in which it revealed the story of CryptoDATA, the past of Ovidiu Toma, its CEO, and a whole series of contents.

APRILIA RNF AND CRYPTODATA: SHOKING REVELATIONS!

This video did not please CryptoDATA, which, however, was careful not to respond to the arguments.
et’s say CryptoDATA did not dare to answer a total of 3 times.
Initially they didn’t do it about my videos and articles because maybe some of the situations were really unclear.
What they did though was file a copyright infringement complaint despite the fact that the material I used was all in the public domain.

It’s an intimidating attitude because whoever receives a copyright infringement doesn’t mind to protest since there are usually legal implications and there is always fear of having to dabble in court.
In my case it wasn’t like that, I sent my counter-notification and in the meantime I posted another video in which I asked Ovidiu Toma, the people at CryptoDATA and other exponents around 40 questions that no one dared to ask.

 

CRYPTODATA SCARED of MISTERHELMET? Questions to Ovidiu Toma, Dorna and Aprilia!

At the same time my counter-notification was forwarded to the author, in this case, CryptoDATA, which had 10 working days to demonstrate that they had brought a legal action against me and to demonstrate that there is an actual copyright infringement.
On my side, I provided my arguments, but the first counter-notification was dismissed as CryptoDATA had asked YouTube for time and then asked me for an explanation.

After three weeks, YouTube, having received no explanation from CryptoDATA and having found Misterhelmet’s explanation satisfactory, decided to restore the video in compliance with the Digital Millennium Copyright Act (DMCA). Misterhelmet 2 Criptodata 0.

It is typical of more recent times to intimidate through legal action and warnings, as has already happened in other situations.
Misterhelmet has already been confronted with this type of situation several times, but, on the strength of his arguments, he has never stopped.
That’s the difference between fearful media in the service of the powerful and independent media.

Qualche giorno fa ho pubblicato un video in cui mi ponevo alcuni dubbi su Cryptodata Tech, sponsor di Aprilia RNF, il team di Razali reduce dall’abbandono di Petronas e dal fallimento del suo precedente sponsor WithU Energy…
Nel video ho evidenziato alcune particolarità dello sponsor Cryptodata, che è anche proprietario del team, dal suo coinvolgimento in attività precedenti al fatto che i suoi prodotti non corrispondono a quanto pubblicizzato. Ho pubblicato tutta la documentazione, la recensione, gli articoli e le fonti. TUTTO. E le trovate ancora tutte.

 

 

 

Anche se non c’era nessun materiale legato a Copyright, deve aver dato fastidio a  Ovidiu Toma e Bogdan Maruntis di Cryptodata che  lo hanno segnalato a Youtube rivendicando proprio questa violazione e Youtube ha rimosso il video. E’ la prassi e lo fa per non avere problemi legali e togliersi dagli impicci.
Ho fatto un reclamo a mia volta e quindi nei prossimi giorni sapremo se verrà accolto.

Nel frattempo però, siccome sono sicuro di essere nel giusto e di non aver usato materiale proibito, perché tutto era disponibile online, mi rivolgo direttamente ad Ovidiu Toma, Amministratore delegato  di Cryptodata e chiedo alcune cose direttamente a lui.

1Cara Cryptodata, è possibile avere un’intervista diretta con qualcuno di voi in modo da poter porre queste domande e altre domande senza che mi sfuggiate?

2Caro Mr Toma, perché ha fatto rimuovere il video motivando con violazione del copyright se tutto il materiale che ho preso è pubblico? Lo sa che il video è comunque online e io andrò dritto per la mia strada?

3Non è che meglio che lei mi lasci fare il mio lavoro e io le lasci fare il suo? 

4Non è che Cryptodata ha paura di Misterhelmet che è l’unico ad aver messo in luce certe cose?

5Ovidiu Toma: vuole chiarire una volta per tutte il tuo rapporto con Karatbars e la truffa schema Ponzi basata sull’oro con il divieto di Karatbars ad operare in numerosi paesi nel mondo? 

6Era Chief Technology Officer di Karatbars o no? Era o non era socio fondatore della cryptovaluta?


7Era lei con il lingotto in mano o no alla presentazione a Dubai? Che fine ha fatto quella cryptovaluta?

8E’ vero che i prodotti Cryptodata erano gli strumenti hardware della truffa Karatbars e sono ancora gli strumenti di Edain e di altre attività da chiarire alcune delle quali classificate come schemi piramidali?


9Ovidiu Toma: vuole chiarire i suoi rapporti con Alex Bodi, arrestato per Human Trafficking e suo socio in Karatbars come viene detto dalla stampa del suo paese? 

10Ovidiu Toma: vuole chiarire come mai i suoi prodotti vengono recensiti ovunque negativamente e vi prendono in giro su reddit e tutte le altre piattaforme libere che non riuscite a bloccare? 

11Come mai disattivate i commenti ogni volta che ci sono commenti negativi suoi vostri canali? 

12Ovidiu Toma: vuole chiarire le recensioni di Cryptodata su Trust Pilot dove parlano di scam e truffa da parte di Cryptodata?

13Ovidiu Toma e Bogdan Maruntis: volete chiarire il vostro ruolo nell’hosting della piattaforma Edain tramite Zixxar? Come mai Edain e Zixxar che è un vostro sito sono stati definiti Schema Piramidale dalla banca centrale Russa?

 

14Avete portato voi Edain da Aleix Espargaro e da Jorge Martin come sponsor?

Potete fornirmi chiarimenti su come funziona Edain veramente? 

15Potete fornirmi chiarimenti su come funziona Zixxar veramente?

 

16Per caso fate hosting di altri siti sospettati di schema Ponzi oltre a questi?

17Potete fornirmi chiarimenti sul Telefono Tinker che dovevate lanciare nel 2020 e invece è scomparso?

Potete fornirmi chiarimenti sull’auto Elettrica Momentum che non lanciate mai e non si è mai vista in movimento anche se vengono dichiarate prestazioni incredibili? Come vengono calcolate queste prestazioni se l’auto non esiste? 

 

18Come mai mi sono rivolto a Dell e ha dichiarato di non avere collaborazioni con voi? 

 

19Come mai dite di avere 14 sedi nel mondo ma non c’è nemmeno un indirizzo oltre a quello in Romania? 

 

20Come è stato stabilito il valore di 200 milioni di euro di Cryptodata Tech se non c’è nemmeno un bilancio disponibile? 

21Da chi è composto il vostro consiglio di amministrazione?

 

22E’ possibile sapere qual è la somma versata al team RNF a copertura della maggioranza delle quote?  

 

23Volete parlare del fondo di garanzia di un miliardo di dollari che dite di aver istituito insieme a Martom e Co per tutelare gli utenti dalle perdite delle cryptovalute dovute a truffe e cattiva gestione?

25Come mai la società assicurativa Martom Brothers &Co da voi indicata  risulta inattiva, con un sito vuoto e non funzionante realizzato da voi, nessun cliente e nessuna traccia di attività?

27Perché dite che non vi occupate di cryptovalute e invece avete una piattaforma per il mining di cryptovalute chiamata Xiden dove state ospitando Edain che è un progetto definito
piramidale dalla banca centrale Russa? Dite che volete difendere i clienti dagli scammer ma chi li difende dal vostro buzzword dei vostri documenti?

28Cosa rispondete a chi vi accusa di fare social engineering nei motori di ricerca riempiendo internet di progetti che poi non vedono  mai la luce allo scopo di avere credibilità finanziaria? 

C29osa rispondete a chi vi accusa di avere solo buzz words sui vostri siti e di non spiegare niente veramente dei vostri progetti e dei vostri prodotti e del vostro codice? 

30Avete ricevuto domande sul vostro business da parte di Dorna, RNF o Aprilia? 

32E infine un’ultima domanda:
Ho violato qualche copyright facendo queste domande?
Andrete a piangere da Youtube? 

33Vi farete intervistare o avete paura di Misterhelmet? 

Adesso una domanda per Dorna:

Sono sicuro che avete effettuato dei controlli in merito a questo sponsor. Potete fornire alla stampa i risultati della vostra analisi? E’ la stessa analisi effettuata nel caso di Tanal Aramco?

Domanda per Aprilia: è vero che il pagamento delle moto è garantito da IRTA ma cosa pensate dell’accostamento del vostro brand ad attività sulle quali non viene fatta chiarezza?

Perché quando vi ho contattato per informarvi avete sottovalutato la cosa? 

A few days ago I published a video in which I asked myself some doubts about CryptoDATA Tech, RNF Aprilia sponsor, Razali’s team back from the Petronas breakup and the bankruptcy of its previous sponsor WithU Energy. In that video I highlighted some peculiarities of the sponsor CryptoDATA, which is also the owner of the team, from its involvement in previous activities to the fact its products do not correspond to what is advertised. I showed all the documentation, reviews, articles and sources. ALL OF THEM. And you can still find them.

 

 

Even if there was no copyrighted material, it must have annoyed Ovidiu Toma and Bogdan Maruntis of CryptoDATA, who claimed the violation to YouTube which then removed the video. It is a common practice and he does it in order to not have legal problems and get out of trouble.

I made a counter-claim myself and therefore in the next few days we will know if it will be accepted.

In the meantime, however, since I’m sure I’m right and that I didn’t use prohibited material, because everything was available online, I’m addressing Ovidiu Toma, CEO of Cryptodata directly, and asking him a few things directly.

5. Ovidiu Toma: Would you like to clarify once and for all your relationship with Karatbars and the gold-based Ponzi scheme scam with the ban on Karatbars operating in numerous countries around the world?
6. Were you Chief Technology Officer of Karatbars or not? Were you or were you not a founding partner of the cryptocurrency?
7. Were you holding the ingot or not at the presentation in Dubai? What happened to that cryptocurrency?
   
8. Is it true that CryptoDATA products were the hardware tools of the Karatbars scam and are they still the tools of Edain and other activities to be clarified, some of them classified as pyramid schemes?
   
9. Ovidiu Toma: would you like to clarify your relationship with Alex Bodi, arrested for Human Trafficking and your partner in Karatbars, as reported by the press in your country?
10. Ovidiu Toma: Would you like to clarify why your products are reviewed everywhere negatively and made fun of on Reddit and all the other free platforms that you can’t block?
11. Why do you disable comments every time there are negative comments on your channels?
12. Would you like to clarify the CryptoDATA reviews on TrustPilot where they talk about scams and frauds by CryptoDATA?
13. Ovidiu Toma and Bogdan Maruntis: Would you like to clarify your role in hosting the Edain platform through Zixxar? Why Edain and Zixxar, which is your site, have been defined as Ponzi schemes by the Russian central bank?
    
14. Did you bring Edain to Aleix Espargaro as sponsor? Can you clarify how Edain really works?
15. Can you clarify how Zixxar really works?
16. Do you happen to host other sites suspected of Ponzi schemes in addition to these?
17. Can you provide me with clarification on the Tinker phone that you were supposed to launch in 2020 and instead has disappeared? Can you give me clarification on the Momentum electric car that you never launch and has never been seen in motion even though incredible performance is claimed? How is this performance calculated if the car does not exist? 

    
    

18. Why did I contact DELL and they said they have no partnerships with you?
19. Why do you say you have 14 offices in the world but there isn’t even an address other than the one in Romania?
20. How was the 200million € value of CryptoDATA Tech determined if there is not even a balance sheet available?
21. Who is your board of directors made up of?
22. Is it possible to know what is the sum paid to the RNF team to cover the majority of the shares?
23. Want to talk about the billion-dollar guarantee fund you say you set up with Martoms Brothers & Co to protect users from cryptocurrency losses due to scams and mismanagement? Here’s the link to the article.
24. The project was supposed to start in September. Why didn’t it start? Will you also protect consumers from the mismanagement of your partners that you host on your Xiden platform?

28. What do you say to those who accuse you of only having buzz words on your sites and of not really explaining anything about your projects, your products and your code?
29. Have you received questions about your business from Dorna, RNF or Aprilia?
30. And finally one last question: Have I violated any copyright by asking these questions? Are you going to cry to YouTube?
31. Will you let yourself be interviewed or are you afraid of Misterhelmet?Now a question for Dorna:I am sure you have carried out checks on this sponsor. Can you provide the press with the results of your analysis? Is it the same analysis as in the case of TANAL Aramco?

    It is true that payment for the bikes is guaranteed by IRTA, but what do you think about your brand being linked to activities about which there is no clarity?

    Why did you underestimate this when I contacted you to inform you?
